Tour de Forth Virtual Challenge (2021)
Terms and Conditions
The challenge is to complete an agreed amount of cycling exercise per month from Monday 1st February 2021 until 31st May 2021 (“The Challenge”).
This Challenge is promoted by Tour de Forth, a Scottish registered charity (registered charity no. SC045762) whose registered office is: Tour de Forth, Caledonian Exchange, 19A Canning Street, Edinburgh, EH3 8HE.
And Cash For Kids which is a Scottish registered charity (registered charity no. SCO41421) whose registered office is: Cash for Kids, Radio Forth, Forth House, Forth Street, Edinburgh, EH3LE.
In consideration of Tour de Forth providing the opportunity to take part in the Tour de Forth Virtual Challenge participants agree to be bound by these Terms and Conditions (the “Terms”) and should read them carefully before registering for and taking part in the Challenge.
1. Overview
1.1. The Challenge will take place from 1st February to 31st May 2021.
1.2. By submitting your registration (the “Registration”), you are indicating your acceptance to be bound by these Terms. If you do not accept these Terms, you should not submit Registration and (and will therefore be unable to take part in the Challenge).
2. Registration
2.1. By registering for the Challenge, you confirm that:
2.1.1. You have legal capacity to enter into a binding contractual agreement with Tour de Forth under these Terms;
2.1.2. You understand and agree to comply with these Terms.
3. Participation and Health & Safety
3.1. Participation in the Challenge may expose you to the risk of personal injury and it is each participant’s responsibility to ensure that they are fit enough to take part. To minimise the risk of causing harm to yourself, we ask all participants to –
3.1.1. take care to ensure that, to the best of your knowledge, you are fit to participate in the Challenge;
3.1.2. refrain from taking part if you are suffering from any disease or medical condition which may prevent you from safely taking part or which may be aggravated if you do take part;
3.1.3. refrain from taking part if they feel unwell/are in pain during the Challenge; and
3.1.4. Seek suitable medical advice prior to and refrain from taking part if they are advised not to.
3.2. Tour de Forth accept no liability for your health or safety while exercising. We encourage you to be sensible and take all safety precautions highlighted to you by your doctors.
4. Fundraising and Sponsorship
4.1. The purpose of this Event is for Participants to use their best endeavours to raise money for Cash for Kids Charities across Scotland (Bauer Radio's Cash for Kids registered charity SC041421 (East Scotland) and SC003334 (West Scotland).
4.2. Through obtaining sponsorship for completing the Challenge. Participants should aim to raise a minimum of £100 each.
4.3. Participants can set up an online giving page through Cash for Kids fundraising platform ‘Giving is Easy’ or Cash for Kids can provide sponsorship forms.
4.4. Any sponsorship money that is donated offline should be in the form of a cheque, which should be made out to Cash for Kids and posted to [Cash for Kids, Radio Forth, Forth House, Forth Street, Edinburgh, EH1 3LE].
4.5. All money raised is the responsibility of the Participants until it is delivered to Cash for Kids or banked online. Cash for Kids recommend that monies raised are kept in a secure place until they are handed over to Cash for Kids.
4.6. All money raised by the Participants must be received banked either via the online fundraising page that you have set up (Cash for Kids Giving is Easy), pay the funds direct into Cash for Kids bank account or pay direct by cash or cheque at the Charity address by 31st May 2021.
4.7. Participants must only use lawful means to fundraise for the Challenge and must not do anything that harms or is likely to harm Cash for Kids’ or Tour de Forth’s reputation. You must always comply with the Cash for Kids “Fundraising Rules”:
4.7.1. All fundraising activities undertaken as part of any Cash for Kids campaign must be legal. In particular, please ensure you refrain from any undue pressure on individuals to donate, especially if they have told you that they do not wish to make a donation.
4.7.2. This may include, but not be limited to, licences from local authorities in respect of street collections and the permission of the owner of any private property on which the fundraising is conducted.
4.7.3. House collections, door to door or in pubs must have a permit issued by the local authority and there are rules that govern this activity. Contact us for more information.
4.7.4. Fundraisers are not permitted to do anything which puts either themselves or anyone else in danger, or which does, or may, damage the reputation of Cash for Kids, and should consider putting in place appropriate insurance. Please note that no insurance cover is provided by Bauer Radio Limited or Cash for Kids or Tour de Forth.
4.7.5. Fundraisers should not leave any promotional literature on vehicle windscreens or trespass on private property.
4.7.6. All money submitted by fundraisers will be donated to Cash for Kids and is non-refundable.
4.7.7. Cash for Kids and Tour de Forth reserves the right to withdraw fundraising support at any point without reason or notice.
4.7.8. Participants must not use Cash for Kids logos or Tour de Forth’s logos without permission.
4.8. Credit card & debit card donations can be made direct to Cash for Kids. Such payments will be processed through Cash for Kids’ secure dashboard payment system at: [https://www.cashforkidsgive.co.uk/admin/donations/one-off/]
4.9. Participants should keep details of the names and addresses of, and amounts donated or pledged by, all donors and provide such details to Cash For Kids when paying in the funds raised for the purposes of claiming Gift Aid.
4.10. Any participant that raises £100 or more, which is banked with Cash for Kids in advance of or on 31st May 2021 will receive a free entry into the annual Tour de Forth sportive event on 29th August 2021. Covid restrictions apply, if the event is cancelled free entry places will not be carried over and can’t be exchanged for cash.
5. Miscellaneous
5.1. Participants take part in the Event at their own risk and will not hold the Event Organisers or any connected persons including Tour de Forth and Cash for Kids responsible, to the fullest extent possible in law, for any accident, injury or illness sustained during, before or after the Event or in connection with training for the Event.
5.2. You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations arising under these Terms.
5.3. A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any term of them against the Event Organiser. However, the Event Organiser is permitted to enforce these terms against all Event participants, including anyone entered as part of a group or family entry.
5.4. If any of these Terms or any part thereof are unenforceable, the enforceability of all other terms and conditions shall not be affected.
5.5. No failure by us to exercise any right or remedy under these Terms shall operate as a waiver of that right or remedy and no waiver by us of any breach of these Terms shall operate as a waiver of any subsequent breach.
5.6. These Terms shall be governed and construed according to English law and the English courts shall have exclusive jurisdiction regarding any claim or matter arising under these Terms.
5.7. You will indemnify and keep us indemnified against any damage, loss, liability or cost incurred by us resulting from any breach of these Terms by you.
5.8. Your use of Cash for Kids and Tour de Forth website(s) and systems is subject to our Terms of Use (www.cashforkids.uk.com/terms-of-use), Privacy Policy (www.cashforkids.uk.com/privacypolicy ), and Cookie Policy (www.cashforkids.uk.com/cookie-policy) and www.tourdeforth/privacy-policy.
5.9. Anyone found to have to have added content deemed inappropriate to a Cash for Kids fundraising page will have their account suspended immediately. Accounts will be reinstated at the discretion of the local Cash for Kids Charity Manager.
5.10 Restrictions for lotteries, raffles and tombolas
· All tickets must be sold during one event, or to people at one place of work (multiple buildings at one site are ok but multiple sites are not).
· No more than £500 of the proceeds can be used to purchase prizes.
· No more than £100 of the proceeds can be used to cover operational costs (e.g. printing tickets).
· Tickets must be sold at the event/on the premises and the result is declared at the event/on the premises.
· There are no rollovers.

5.11 Do’s and Don’ts
Do approach companies/organisations to donate products that you can raffle off etc.
Do keep in mind that Cash for Kids are a children’s charity when planning ways to fundraise, so try and stay away from events with adult themes. Please call us for clarification if unsure.
If you want to collect in public places then please remember if you are collecting at a shopping mall, supermarket etc. then you will need the owner’s permission. You cannot do a street collection without a license from the local authority.
We are happy for you to use the Cash for Kids logo online or in any promotional materials but there are some guidelines. Please contact us for details.
Do encourage anyone who is a UK Taxpayer and donates on your page to include Gift Aid as this will benefit the charity with no additional cost to you or your supporters. We can claim 25p from HMRC for every £1 donated.
